Terms of Use
These terms govern your use of codewinklabs.com. Our software products are covered by their own license agreements and terms, linked in section 2.

1. Agreement
By using the website at codewinklabs.com (the "Site"), you agree to these Terms of Use. If you do not agree, do not use the Site. These terms are between you and CodeWink Labs LLC, a Louisiana limited liability company ("CodeWink Labs", "we", "us", "our").
2. Product terms
Downloading, installing, buying, or using any software we publish is governed by that product's own end user license agreement, terms of use, refund policy, and privacy policy, not by these Site terms. For Panelogue:
If you obtain a product through a third-party store such as the Mac App Store or the Microsoft Store, that store's terms also apply to the purchase, and purchases and refunds are handled under the store's rules.
3. Using the Site
You may view the Site and share links to it for any lawful purpose. You may not attempt to gain unauthorized access to the Site or the systems that serve it, interfere with its operation, scrape it in a way that burdens it, or use it to distribute malware or unlawful content. Automated access for search indexing and for AI assistants that respect our robots.txt is permitted.
4. Intellectual property
The Site and its content, including text, design, code, and images, are owned by CodeWink Labs or used with permission, and are protected by copyright and other laws. "CodeWink Labs", the CodeWink Labs mark, "Panelogue", and the Panelogue logo are trademarks of CodeWink Labs LLC. You may not use them without our written permission, except to refer to us or our products accurately. Screenshots of our products may be used for review, commentary, and educational purposes with attribution.
5. Third-party links
The Site links to third-party sites and services, including app stores and our payment provider. We do not control them and are not responsible for their content or practices.
6. No warranties
The Site is provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. Some jurisdictions do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you.
7. Limitation of liability
To the fullest extent permitted by law, CodeWink Labs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the Site. Our total liability for any claim relating to the Site will not exceed one hundred US dollars. Nothing in these terms limits liability that cannot be limited under applicable law, including for death or personal injury caused by negligence, fraud, or, for consumers in the EEA and UK, your statutory rights.
8. Governing law and disputes
These terms are governed by the laws of the State of Louisiana and the federal laws of the United States, without regard to conflict-of-law rules. Any dispute relating to the Site will be brought in the state or federal courts located in Louisiana, and you consent to their jurisdiction. If you are a consumer in the EEA or UK, you keep the protection of the mandatory consumer laws of your country of residence and may bring a claim in your local courts.
9. General
If any part of these terms is found unenforceable, the rest remains in effect. Our failure to enforce a term is not a waiver of it. These terms are the entire agreement between you and us about the Site. We may update them; the current version is always at codewinklabs.com/terms.html with its effective date, and continued use of the Site after a change means you accept it.
